Protestors Rally Behind D135 Secretary Forced Out of New Job
A 15-year district staffer was told the school board was "unhappy" with her promotion and she could either resign from her new post or return to her old job without filing complaints.
Melanie Walsh arrived for work on Sept. 21 and prepared for a day like any other. Within hours she was suspended and told to leave.
Three months earlier, after 15 years as a paraprofessional at Orland School District 135, she was promoted to secretary of student services.
On her last morning with the district, she was called into Superintendent Paul Howell’s office, along with the school system's attorney and her union representative. Howell allegedly told Walsh the board had been “unhappy with the hiring process” and gave her two options: return to her former position or resign.
“I was absolutely, 100 percent blind-sided,” Walsh said as she stood outside the District 135 Board of Education meeting on Monday.
Several hundred people filled Monday night’s meeting room to voice discontent with the board’s decision on Walsh’s job.
A district employee described the actions against Walsh to be “more vindictive than anything.”
Several sources within the school district told Patch that the attempt to force Walsh out of her job stems from her being related to Colleen Schultz, assistant superintendent of student services, and that board member Ann Gentile made the initial push for Walsh to leave the district.
Some claim a friend of Gentile had applied for the job and didn't get it, while others said Schultz purposely distanced herself from the hiring process. When asked by Patch, Gentile declined comment on the allegations.
Walsh said she couldn’t imagine being faulted for following the board’s own hiring process. What’s more, she interviewed several times for the position and has received excellent evaluations with the district thus far, she said.
The Illinois Federation of Teachers (IFT) filed a grievance against the district last week for asking Walsh to waive her union rights by returning to her old position and for suspending her with pay for longer than 10 days, according to Eve Bukowski, a union steward for the district.
“The termination of this employee is not for cause,” she said with several hundred cheering supporters, including Walsh, at her back. “The collective bargaining agreement has been completely ignored and this is a blatant disregard for the value of not one dedicated 15-year employee, but a blatant disregard for all 638 employees I represent.”
After the meeting, board member Joe LaMargo said he agreed with Bukowski, though he refused to delve into the details of the board’s closed-door discussions on the issue.
“We can’t argue with any of those points,” LaMargo said. “It was posted correctly, she applied for the position … she was recommended, she fit all the qualifications, and she’s been doing the job. There shouldn’t be one penny of taxpayer money wasted on this.”
Bukowski said the Orland Council Educators are prepared to take legal action “at whatever cost" out of its own pockets and "however long it takes."
Walsh and two representatives from IFT were present during the board’s closed-door meeting on Monday night. The board ruled for Walsh to return to her old job, with members John Carmody, Tom Cunningham, Tina Zekich and Gentile voting in favor. Board members Mary Bragg, Lynne Donegan and LaMargo voted against transferring her back to her former paraprofessional position.
Neither Walsh nor any board members made comment after the decision was announced Tuesday morning.

This is absolutely absurd! Melanie Walsh is an excellent employee and does a fantastic job! She went through the District's hiring process and got the job on her own without any influence from anyone. If knowing someone in the district is a crime why hasn't anyone investigated John Reiniche's on-going nepotism? The board has had no problem approving the hiring of his father, brother-in-law, friends of his family, neighbors, etc. Why not ask the principal of Jerling how she knows Mr. Reiniche?
This is a case of one board member (Gentile) and her personal vendetta against Colleen Schultz who heads special education. Gentile has a handicapped son and has butted heads with Schultz for years. It is unfortunate that Melanie Walsh has become collateral damage!
This also brings to light an on-going issue of the Board voting block of Gentile, Cunningham, Carmody and now Zekich (Gentile's friend who also has a handicapped child) who push each others' and John Reiniche's agendas. Shame on them!
This board and the entire District Office needs to be investigated! My next e-mail will be to Attorney General, Lisa Madigan!

I think its time to ask the Better Government Association to investigate. Sadly, we thought we elected a board that wanted the best for the children of the district, when instead it is only about them or their own kids/agenda.....payback for wronging their child (what about mine???), reserving sports fields at a discount or free (when my kids have to pay and use proper channels???). If you want to coach in this town, a background check is needed......Maybe should be a thought for those running for office?
Wasting the taxpayers money in Orland Park is not what I signed up for when I voted. BOE: Find a new hobby that is on par w/your mentality and leave our kids alone!

There are over 100,000 members in the IFT, Illinois Federation of Teachers. It is one of the most important, influential and well respected organizations in the world. The IFT does not act on cases involving it's members without very careful deliberation. The IFT has a Board with some of the state's best attornys on it. The IFT has approved legal action be taken against the "FAB FOUR" and Superintendent Howell, on behalf of Melanie Walsh. So, there are over 100,000 members who essentially stand behind Melanie. There is a team of lawyers who stand behind Melanie. There are 3 DISTRICT 135 BOARD MEMBERS who stand behind Melanie. There is a huge community of Orland residents who stand behind Melanie. Orland's own teachers stand in support of Melanie. Yet, at last Monday's BORED meeting, The "Fab Four" and the superintendent of 135 - told all these people, groups, lawyers, taxpayers, and their own Bored members, "WE DON'T CARE!" We will spend Orland taxpayers money to take on the AFT, IFT, OCE, 3 fellow Board members, and the Orland Community and try to defend something that we cannot possibly win! OMG! What a waste of time, energy, and money. Please don't tell us that the "Fab Four" and their chums , their full time attorney paid for by the taxpayers of Orland- the business manager- Dr. Howell, and company- are the same group that walked out of the room a few weeks ago during teacher contract talks?!@# My "friends and neighbors" here in Orland are outraged.

I think they know they made a mistake and they don't want a lawsuit and a monetary judgement.
How can these people look one another in the face knowing that one of them is disgustingly WRONG.

Frank, you read my mind-- I immediately thought, "So the Board, without any hesitation or question--is positively 100% sure, she is worthy of returning to her old job?" Which to me is more important, because she is working with children!
Sounds like a personal vendetta and the Board is trying to do the usual CYA. This definitely needs reconsideration!

Unbelievable! I've heard that these four board members are in bed with each other (figuratively, I hope) and that John Reineche is a power-hungry dictator but this really takes the cake. These four board members are CORRUPT! Forget the Triangle Project and 9750...the bulk of our taxes go to the school district and this is what we're getting? A corrupt, self-proclaimed "assistant superintendant" business manager and board members with agendas that have nothing to do with our children. The board president's kids go to St. Mike's, Cunningham doesn't even have kids in the district or pay property taxes (as he doesn't own the condo he lives in), and Gentile and Zekich who only care about special education kids. Where is Andrea Williams? If anyone could, she could get to the bottom of this!

I don't understand why some of you are involving the Business Manager in this. he does not make hiring decisions, especially in the Student Services area. Having said that, I agree that the board made a bad decision here. Ms. Walsh had to be approved by the board to get that promotion in the first place. If there was a problem with the process, they had ample opportunity to speak up at that point. Four board members could have stopped her promotion before it ever took place. It's one thing if the position was eliminated altogether, but this does not appear to be the case. Also, why has Mrs. Gentile refused to comment on this?

John- u r so wrong. The business manager has had a direct hand in hiring numerous employees such as relatives and friends such as Hodgson. And the Board just extended his contract for 5 more years and they are paying for him to get his PHD.

Politics for the board members only! So many special priveligaes granted for a select few. Isn't the board going after a man who had a child in the district; yet a current board member NEVER had to pay for his child attending the district? What happened to investigating these people who run the board? I understand that there are allegied allegations about police records for some of the board members. Really? Who is going to investigate this? Or do we just turn another blind eye to this corruption? Is there a nepotism policy? If there is and she is related, then there is a violation of policy. If not, she should be able to keep her job. Was the board informed that she was related to Colleen? This is a question that can only be answered by Dr. Howell and the board. Also, if she is related then she really should have never worked at a para if she is related to Colleen. I think the first thing is to find out if there is a policy against hiring relatives? If not, and the board feels this way, they should have a policy on it.

She is currently setting up her office at Prairie school in a classroom because of the childish, vindictive and completely unprofessional actions of these board members. All the while, the taxpayers are paying her and her replacement a salary plus benefits to do the same job for an entire calendar year. Again, board approved decision making! Oh and the teachers are working without a contract~ Let's see how long that lasts! OMG! Please do not attack Ann personally for having a special needs child. If any one of you had a special needs child, you also would fight to get that child the appropriate education. Believe me, Orland 135 needs a lot of improvement in that area. My son graduated from OJH back in 2003. What a joke the special ed services were. I almost went to Due Process (lawsuit) to get my child the help that is required by law to get. Colleen Schultz was one of the problems. D135 was the problem. I had to fight for my son becuase I knew that no one else would. I had an administrator tell me that my son would be a failure at life and never succeed in anything. I had OJH lie to me several times regarding my son's education. That principal is no longer with our district! I filed four complaints againt OJH withe the Illinois State Board of Education (ISBE) and won all four of them. I could have filed more, but I decided to pick my battles. Please do not attack Ann for having a special needs child. You don't know what life is like with one.

I know Ann personally. The issue here is not her having a special needs child, but the way this demotion was handled. They need to go and ask for the POLICY that says it was done incorrectly. If there is not a policy regarding it, then how could her hiring not be done correctly? Procedures are one thing, but POLICY is the main thing.

Blah, blah blah, if you want everyone to hear your story, write a letter to the editor! This is about Mrs. Walsh and the stupidity of the BOE. The BOE hires a qualified staff member, who went through the correct protocol, she works for three months, there were no complaints or bad reviews that we know about, and all of a sudden, she needs to "turn in her badge." BOE start explaining so we can fill in the blanks.

joe lyons
7:39 pm on Tuesday, October 18, 2011
Ted, you are right on. However, I think we need to see the whole picture. Ann first sues the district to make sure her son get the services he needs. !st strike against Ms. Schultz. Then Ann runs for school Board to make sure her son gets the services he needs. Second strike against Ms. Schultz. The problem is that Ann doesn't have a majority on the Board. So, then Ann puts up the money for her best friend to run for school Board(Zekich). Now she has a majority for all decisions that are made. Then Ann hires Ellen, her friend(nepotism) to shadow Ms. Schultz and make 135,000 a year. Then, the Board hires Schultz's friend legally for secretary. 3rd strike against Ms. Schultz. Ann doesn't know about it because she is not at the Board meeting that night. When she finds out, Ann decides they must get rid of the secretary. Then, Ann decides to force Ms. Schultz out of District office and into a room at Prairie school. So, nepotism is okay for Ann, but not for anybody else? Everyone knows that Mr. Reiniche has also used his position to hire both friends and family. We can all agree Ann is a runaway train! How do we petition for her removal? Better yet, she should step down and save the taxpayers the embarrassment. The teachers and District would be better off without her services.

Gentile having a special needs child is definately not the issue here. The problem is that she behaves like she is still in high school. The school board should be concerned about ALL the students, not just Gentile's child and her friend's children. Gentile does not have a clue about education or educational policies.

Kathy, you have a good point about the two responisibilities of the board, but neither of those responsibilities include following a personal vendetta at taxpayer expense. I agree that the issue is Ann having a special needs child. I just went to her defense because everyone was bashing her for trying to fight to get her child the appropriate education. Kudos to that.
From what I have read here, Melanie got the raw end of the deal. They have to find policy that shows she was hired the way the policy was written. Then they can go from there. Barb Rains also had this happen to her several years back. A policy is needed and needs to be followed for all future hiring. Better yet, they need to write it into the union contract on what the procedure is when hiring new employees or current employees transferring.
Personally, I don't feel that John Carmody should be president. He didn't even send his kids to D135. When he ran 4-5 years ago, his platform was to protect the tax payers of Orland who don't have kids in the school. Ask him about how he and John Reiniche reserved the baseball fields for the junior high softball games whenin realityit was for his Sparks baseball club. Tom Cunningham was president at that time.

The Board members were voted in. Problem is- most of the voters didn't know what they were in for when they voted. The "Fab Four" now make decisions that affect the lives of thousands. Think about this. The "Fab Four" can basically do anything they want to do. It's scary. If we just had one single person on the flip side of the 4-3 votes- all of this would never come down. The difference between complete lunacy on the Board as it is now and sensibility is one single person. The children are paying the price for this. Orland school district has never been in such disarray since the strike in the 1970's. The children are paying the price. All this time and energy spent on things the "Fab Four" and their admin buddies create. The teachers are paying the price also. The energy is being sucked right out of the teaching ranks. The children are paying the price. I propose a "rally" be held a week from this Saturday in the parking lot of District Office. The taxpayers of Orland Park need to rise up and ask for resignations of everyone responsible for these travesties. From the top on down. We are not paying for chaos. Kathy Quilty,
As you well know, there is no nepotism policy in the district. There are numerous employees of the district who are relatives of board members, administrators and other staff members. We all know that this issue with Melanie Walsh was raised solely and completely because of Ann Gentile's vendetta against Colleen Schultz. And, as point of fact, the reason you did not go forward with your lawsuit (due process) is because you had no case. You personally aligned with Ann in her vendetta against the district and anyone who is aligned with Colleen Schultz. Shame on these four board members for not doing their job and wasting tax-payer money.

There was a nepotism policy I believe back in the '80's. It was removed because many good teachers were overlooked, just because they had another family member teaching in the district. Over the years, my children had some of the family members of others teachers, and it was a great experience! Nepotism is when favoritism granted to relatives or friends REGARDLESS of merit. (& I'm not saying this does not happen.) IF there is a process in place, that is consistent and fair, and is followed everytime, to recruit and hire the best... this would not be a problem.

Does anybody else think it's inappropriate for a current D230 Board member (Ms. Quilty) to side with the person most responsible (Ms. Gentile) for this fiasco in the first place? The purpose of these discussions is to determine whether Ms. Gentile is targeting Ms. Schultz directly, not to hear about Ms. Quilty's problems with the Special Ed department in the past and how many complaints she filed. We would have more respect for that, than to continue to cling to a ship called morals and integrity~ that is taking on water.

Absolutely great point Frank, the biggest issue here is the unfair treatment of Melanie Walsh. My opinion, for whatever it's worth, is that the wrong against Melanie needs to be made right before we taxpayers eat a potentially very large bill, and more importantly, because it's just the right thing to do.
The underlying issue in the larger picture is that this wouldn't be happening if not for the "Fab Four" banding together to follow the personal agenda of their fearless leader. I can fully sympathize with the fact that Ann Gentile wants everything possible for her child. But, it's not ok to use her position in office to fire an innocent person and to throw away our tax dollars to accomplish a personal goal.

All that I have heard and read about Ms. Walsh is that she is a loyal, hard-working and valued employee. I do not think the Board would have offered her - her old position if this was not true. The issue at hand is that the Board made a mistake. The Board oversees the hiring processes. If they had a problem with the process, why wasn't it handled before interviews took place? Instead, Ms. Walsh went through the process and was chosen as the top runner. This recommendation was brought to the Board. Again, they had a chance to refute the process, Ms. Walsh was approved by a majority of the Board to take the position. (btw, what was the vote on that?)
NOW, all of a sudden, the process not acceptable! So as the Board is covering its butt, the district attorneys are faring nicely as they advise and show up as the drama to plays out. How much is this going to cost when it is all said and done? The BOARD needs to rectify a mistake they are making BEFORE more of our tax money is wasted on a lawsuit/court case that has weak legs to begin with and will end in the people of Orland paying Ms. Walsh for damages, and her attorney's fees.

I must agree, if no FAVORITISM was involved then she should keep her job. FAVORITISM to me has nothing to do with her relationship to anyone. I have seen many employees working at the district that are related to others and did not deserve their jobs. It is not what you know, but WHO you know. But, if Ms. Walsh got her job based on merits and simply happens to know or be related to someone, then that is mere coincidence.

Reading these posts, it looks like just everyone is posting their opinions, and no one really knows what the real reason is that Ms Walsh was asked to return to her former job, or has proof to back up their statements. So I recommend we all wait to see what is discovered during the Orland Council Educators' lawsuit they're filing against the board. Its sad how the truth can only be found during lawsuit investigations now days, but thankfully they're willing to pay for it themselves. And the outcome should determine which of these 7 board members have a chance at being re-elected their next go-around.

Megan, I think the reason for all the opinions, is that the school districts that serve 135 and 230 are a BIG part of our tax bills. I hope we do not have to wait for the results of the lawsuit investigation. We are glad to and emphatically support education and the children of our districts. What I (and I think I parallel the feelings of many) am not happy about is that FOUR people have just decided to take my tax money from the children and put it to use to fight their sophomoric little battle. We thought we could have more confidence in the BOE than that! After reading and hearing all this, TAKE NOTE DISTRICT 135: We will NEVER, EVER support a referendum for your district EVER again! Unfortunately, children seem to be punished for adults stupid decisions. Remember this by Phil Kadner?: http://www.studentsfirst.us/news/contentview.asp?c=152077

Iceman63 - I totally agree with you! But I fear that the only way we, as the taxpayers, will ever really know who is right in their decision, is through an investigation prompted by a lawsuit. Unless taxpayers want to pay for an independent investigation of their own.
And I agree...it would be terrible to have to wait for that. But without these 4 budging or providing any reasoning for their actions, its just a he said/she said issue. If a lawsuit investigation proves that they made the wrong call, then sadly, it will probably be taxpayers money paying for their failure as board members. But at least we would all know, and could take action to have them removed from office or at least be knowledgable enough not to re-elect them back into office.

There is some talk that these "4" went against the board attorney's advice, and were willing to terminate this employee while incurring legal bills totalling in excess of $100,000+....for a $34K a year job. Supposedly they didn't care, and wanted her out for Ann's sake. Is this fiscal responsibility? Is this fair to the taxpayers? Where is Zekich on this? She's supposedly an attorney or is she too busy trying "NOT" to bite the hand that feeds her? People are losing their homes and their jobs and this is their mentality?

Please cease the personal attacks in this venue. Examine the facts at hand. Ms. Walsh applied for a secretarial position, obtained Board approval, landed the job, and successfully performed her duties.
As a longtime resident taxpayer of Orland Park and former President of the Orland Council of Educators, I am appalled at the actions of the 135 Board. How much of the hard-earned taxpayer monies has the Board spent and will continue to spend defending actions that are clearly in violation of the collective bargaining agreement?
The legal costs associated with this inevitable grievance and past litigations have cost the taxpayers of Orland Park dearly, and have served only to line the pockets of the Board attorney. The shocking legal fees of the school district are a matter of public record. All this because the Board and administration refuse to admit they erred in judgement.
There was a time when 135 was considered a stellar technological school district. That is no longer the case, due to fiscal decisions. Spend the monies instead on upgrading the outdated technology so that the children of Orland Park will be afforded the opportunities they deserve and in settling the still unresolved teacher contract. The teachers and support staff seriously want to do what is best for the children of Orland Park.
Do the right thing and "Play Nice."

Having worked in Orland 135 for 35 years, I just want to say that this is not the spirit in which this school district thrived for most of my tenure. There was a day when there was good will between the community, school board, teachers, and administration. The kind of behavior exhibited here was unheard of. This kind of treatment of personnel is stressful and distracting for all those who work their hardest day after day to provide an excellent education for the children of Orland Park. I would urge the school board to focus on the children and their education, which in no way are affected negatively by Ms. Walsh's position.

I agree Officer of the Court - please do not name a minor child here. What concerns me as a taxpayer and a parent is that this school board is making decisions that appear to be based on vendetta and revenge. Their decision regarding Ms. Walsh as well as some other decisions do not appear to be in the best interest of all the students, employees, or the taxpayers. If the school board members had to pay the financial costs themselves instead of the taxpayers, I believe they would be making better decisions. For whatever reason, some of the School Board Members are behaving like the taxpayers of Orland Park are growing money in our backyards to pay for their inappropriate decisions. Well, my "money tree" is dead, and I have had enough. I trusted this school board with overseeing my children's education. It appears that some of it's members are too immature and not capable to handle that responsibility. Because of their bullying tactics, disregard of policy, lack of decency towards district 135 employees, and vendetta behaviors, I am all for replacing these four power hungry school board members.

Just a few thoughts on this. I see alot of attacks on various administrators in the district. Keep in mind, they work for the board. If the superintendent is directed by a majority of the board to demote someone, he really hasd no choice unless he wants to risk his own job. Also keep in mind that there is no way any of these people, including the board can please everyone all of the time. When I served on the board, I realized that the more you do, the more friends you make; also, the more enemies you make.
If I had to guess, I'd say that the board majority overplayed thier hand on this. They may have thought that Mrs. Walsh would go away quietly. I see that she has already reapplied for the job, this would give the board a chance to save face and rehire her with the "process" they approve of.
That part is also suspect. First, there is no policy that dictates a hiring process. Unless things have changed since I was there, an administrator could use whatever process they chose as long as it was consistent and fair. Any questions about that should have been addressed by the board BEFORE it voted to approve Mrs. Walsh's hiring. Someone should ask Mr. Cunningham, Mr. Carmody, Mrs. Gentile and Mrs. Zekich why they didn't address this when it would have been easier to deal with.

Thanks for the update Jesse.
Curious...do you know if board members get a copy of the agenda prior to the meeting. So if they chose not to be there, they're consenting to giving up their right to vote on the topic at that time? If they knew it was on the agenda, then they should have made sure they were at the 6-27 meeting to vote.
I really getting tired of reading how some elected board members, no matter if for the school district, village or fire district, are failing to show up at their meetings. They were elected to be there. If they can't be there for every meeting then they shouldn't run for office. The only acceptable excuse for an absence should be a medical emergency or death in the family. If other work or personal obligations are preventing them from fulfilling their duties, then they should resign.

Sue,
To my knowledge, prior to meetings board members are provided with a packet that includes the upcoming agenda and any relevant information from staff about ordinances, employment, etc. Whether Mr. Cunningham and Ms. Gentile were provided with a packet before the June 27 regular board meeting and why they missed the meeting are questions I do not have an answer to.

Sue,
Yes all board members get a board packet about 4-5 days before a board meeting. That agives them ample time to ask questions before the meeting or even at the meeting. That being said, sometimes the board members aren't given the background on everything and they must askk for the info. the board member not may realize they were not given all the information until after the fact.

Isn't the staff at 135 there to educate our children in the best way possible? Isn't that the first and foremost priority at a school district? How is this issue benefiting the children? It seems to me what is going on, the children are getting lost. Please put the focus on the children that are our future leaders instead of personal vendettas or egos.

With all that is happening in S.D. 135, I'm surprised we haven't heard more from Dr. Paul Howell. Isn't the board supposed to set the direction it would like for the 135 ship to sail? Isn't it the Superintendent who reads the map and directs the ship and crew? I don't think we have it right here at 135. It seems like the "Fab 4", under the direction of the little captain, John, is micro-managing our journey and doing things that benefit them and not the people who matter: STUDENTS, TEACHERS and PARENTS! How many of these four board members and little captain John have hired friends and family with no regard to qualifications? Isn't it time that our REAL captain, Dr. HOWELL, put a stop to this nonsense? How much is it going to cost the taxpayers before they wake up and toss the whole bunch overboard?

Our postings in regards to Mrs Walsh have taken on a nautical theme of late and
a more than subtle overture that their leader swim with the fish.
I don't know about you "john Q public" but I find myself questioning my decision as to why I moved to Orland Park.
Sure, we have elected officials we consider outstanding but collectively recent decisions have made our Village a laughing stock and worthy of rivaling other
U.S. cities that have made the Leno and Letterman Shows.
I'm too old to change the system but I'll gladly contribute to or assist someone who
will step up to the plate and deliver a common sense approach without a self serving or hidden monetary need. The future is now and ELECTIONS like TAXES always come around.

Carol, Dr. Howell works for the board. Its obvious by their recent actions that the board does not care how much tax money might be wasted in order to be able to inflate their egos. I don't doubt for a minute that this board would get rid of Dr. Howell in two seconds if he stood up to him, even if it means that they would have to eat his contract. Dr. Howell has worked in this district for a long time and finally reached his goal of being Superintendent, he can't be expected to throw it all away now.

John Paul, Rumor has it that the board has already shortened Dr. Howell’s contract and are going to pay him for the years remaining. There comes a time when a person has to stand up and do what is right and ethical regardless of the personal consequences. The question is whether Howell is also being bullied into doing something he does not agree with or is he in agreement with the 4 school board members? I am sure that all the districts students, parents, and employees would expect Howell and the board to respect and protect what is best for the students. Unfortunately, that is not the case here.

If you believe that rumor to be true, you can send a FOIA (Freedome of Information Act) letter and request a copy of his most recent contract. There is so much information out there that is available to tax payers ... you just need to know how to ask for it. If you are not specific enough, you may not get what exactly you want.
And John Paul is completely correct when he says that if a board has a majority of the votes, they can get rid of anyone at any time.
