Should the Jurors Know Kustok Cheated on His Wife?

Judge John Hynes is expected to decide Thursday in court whether jurors for Allan Kustok's upcoming murder trial should be able to hear about his infidelity and financial issues.

Allan Kustok is facing murder charges in the shooting death of his wife Jeanie in September 2010. After over three years, the trial is tentatively scheduled to start in December, depending on witnesses and experts slated to testify.

Judge John Hynes heard arguments last week as to why the Cook County State’s Attorney’s Office thinks jurors should be able to learn that Allan Kustok cheated repeatedly on his wife before she died. Prosecutors also argued that jurors should be able to hear that Allan and Jeanie Kustok’s finances were in dire straights.

Kustok’s attorney Steven Rueckert argued that Kustok had nothing to gain financially from his wife’s death, and that the affairs might have a prejudicial effect on jurors.
