  ●  “Loss of normal life” which the law defines as “the temporary or permanent diminished ability to enjoy life, which includes a person's inability to pursue the pleasurable aspects of life.

   ●  Disfigurement

   ●  Aggravation of a pre-existing condition or ailment.

 

          What constitutes fair and reasonable compensation for each of these elements of damages depends on factors like the nature of the injury (ie. a broken bone vs. a sprain); the extent of the injury (ie. a simple fracture vs. compound, multiple fractures); and the duration of the injury (ie. how long your recovery takes, or whether you recover completely at all, etc.).

          Especially in cases involving serious injury, you want to be certain that the fair compensation to which you are entitled includes consideration of all of these elements of damages, because you have only one opportunity to receive fair compensation.  If, down the road after your case is resolved, you discover that the compensation was not enough, you cannot go back and ask for or receive more.
