Lawyer: Actor in Porn Video May Be Of Legal Age

An attorney for a 58-year-old Orland Park man accused of possession of child pornography and stalking told a Cook County judge Wednesday that he wants to verify to age of the person in a video in the child porn case.


An attorney for an Orland Park man accused of possessing child pornography and stalking two girls told a Cook County judge during a hearing Wednesday that he may have evidence of the person's age in the video that led to the pornography charge.

James Shaver, 58, was arrested and charged with stalking in March of 2011, for reportedly stalking two girls, ages 9 and 11, and was later charged with possession of child porn after police say they found videos on his cell phone.

Shaver is out on $20,000 bond and appeared in court Wednesday but didn't speak during the hearing.

Regarding the child porn case, defense attorney Jeffrey Aprati told Judge John J. Hynes that he has significant evidence regarding the age of the person in the video. Calling the evidence "exculpatory," -- which, by definition means in favor of the defendant -- Aprati didn't elaborate on the evidence.

Aprati asked for the next hearing date to be in late February to allow for time to gather the evidence, but prosecutor Debbie Lawler didn't appear to share his sentiments.

"We're not requiring more information, Judge," Lawler told Hynes. "We have a disagreement about the age of the person in the video."

Ultimately, Hynes asked for all parties to come back to court in early February.

Shaver is scheduled to appear on Feb. 7 for status.
