Convicted Wife-Killer Allan Kustok Bids For New Trial, Sentencing on Hold

On the day he was to be sentenced to prison for shooting his wife in the face, Allan Kustok's lawyers asked for a new trial.

Attorneys for the Orland Park man convicted of killing his wife of 34 years, Anita "Jeanie" Kustok, filed a 24-page motion for a new trial Thursday. Kustok's lawyers have also asked Cook County Judge John Joseph Hynes for permission to perform chemical testing on a pillowcase from the bed in which Jeanie Kustok was killed.

On the morning of Jeanie Kustok's death in September 2010, Allan Kustok claimed he woke to a gunshot and found her dead next to him in bed.

Instead of calling 911—or anyone else—Allan Kustok, 63, picked up the six-shot revolver on his wife's body and fired the five remaining bullets into an armoire.

He cradled his wife's bloody body for at least 45 minutes, then "wrapped her in a robe, bedsheets, pillowcases, towels—he literally wraps her up like a mummy, like a piece of meat," prosecutor Jim Papa said during Kustok's three-and-a-half-week trial.

Once he had his wife wrapped up, Allan Kustok loaded her into his SUV and drove her to the Palos Community Hospital emergency room.

While defense attorney Rick Beuke described the Kustoks as a happy devoted couple, prosecutors called five women to testify about either having affairs with Allan Kustok or to tell how they were pursued by him. One woman recalled her five-year-affair with Allan Kustok and how she only learned he wasn't her only mistress after Jeanie Kustok was killed.

Beuke called the women's testimony a "desperate attempt to throw trash all over the marriage and relationship."

Allan Kustok's trial ended in March. It took the jury less than two hours to find him guilty of murder. He will be sent to prison for 45 year to life.
