Judge Won't Raise Alleged Orland Park Wife-Killer's $2 Million Bond

Prosecutors wanted Allan Kustok to be held without the possibility of bonding out.

In the more than two and a half years Allan Kustok has been locked up for allegedly murdering his wife, he has yet to scratch together the $200,000 he needs to get out of custody.

On Monday, a prosecutor argued that Kustok should have no hope at all of securing his release before trial.

Cook County Assistant State's Attorney Jennifer Gonzalez moved to have Kustok held without bond. Gonzalez argued that an expert determined Kustok used a gun to kill his wife, Anita Kustok.

Since Allan Kustok used a firearm, another 25 years—or even a life term—can be tacked on his sentence if he is found guilty, Gonzalez said during a Monday morning hearing at the Bridgeview courthouse. And with Allan Kustok looking at life behind bars, Gonzalez said he should have no chance at all of getting out of jail.

"The defendant had high-velocity blood-spatter on his clothes and his glasses," Gonzalez said, adding, "The defendant's statement to the police does not put him in the position that he would have blood spatter" on his clothes and eyeglasses.

But Allan Kustok's attorney, Rick Beuke, said he has two experts of his own saying exactly the opposite of what Gonzalez's expert claims.

Beuke said his experts determined Kustok was covered in "not blood-spatter but blood-transfer," that their contention "completely contradicts" the prosecution's theory, and that the conflicting reports have shaped up to be a "battle of the experts."

"It has been consistently mentioned by Mr. Kustok that he did not fire the weapon that morning," Beuke added.

Beuke has said in previous interviews that Kustok woke the morning of his wife's death in September 2010 to a gunshot. When he went to investigate, Beuke said, he found Anita Kustok dead.

Anita Kustok had been shot in the head with a .357 Magnum she had received as an anniversary present.

Allan Kustok is being held at the Kankakee County jail. He was transferred there shortly after his arrest when officials learned he had worked as a sanitarian at the Cook County Jail from 2004 to 2007 and is familiar with the inner workings of that facility.

Allan Kustok's bond was initially set and remains at $2 million. He needs to post 10 percent of it for his release, and Beuke pointed out that has yet to happen.

Cook County Judge John Joseph Hynes denied the motion to increase Allan Kustok's bond.

Besides arguing over Allan Kustok's bond, the attorneys told Judge Hynes they plan to go to trial Sept. 16.
