Main Street Triangle Case Delayed Again Without Judge

Possibility of an out-of-court settlement is growing, though attorneys for the Orland Plaza tenants say they aren't part of those discussions.

Main Street Triangle court proceedings were stalled again this week as attorneys waited for the appointment of a new judge.

Judge Sanjay Tailor was reassigned in January to the commercial division of the Cook County Circuit Court, interrupting efforts to set a , which the village was awarded through eminent domain. Orland Park officials plan to turn the area bound by LaGrange Road, 143rd Street and Southwest Highway into a pedestrian-friendly city center with shops, offices, restaurants and condominiums.

Attorneys for both sides met in court Thursday and received a new status date for June 16 with the expectation that a judge will be assigned by then. That's if a settlement hasn't been reached.

Some, including Mayor Dan McLaughlin, believe the village is getting closer to agreeing on a price . Others close to the lawsuit say the parties could settle within the next week.

Either way, attorneys for the Orland Plaza tenants have not been privileged to settlement discussions. They say their own proposals have been rejected without counter offers.

“The village isn't negotiating with us at the moment,” said Bill Ryan, who represents four plaza tenants. “They’re negotiating with the owner.”

Messages left with Cass Wennlund, an attorney for plaza owner George Gee, and Scott Day, who represents the village, were not returned.

Some of the tenants are looking for an offer that would include the difference between the rent they currently pay and what they will pay elsewhere. Several of them possess leases that are good for several more years, according to attorneys.

McLaughlin said the village is also talking with a developer to build up the area.
