Judge Won't Raise Alleged Orland Park Wife-Killer's $2 Million Bond

Prosecutors wanted Allan Kustok to be held without the possibility of bonding out.

In the more than two and a half years Allan Kustok has been locked up for allegedly murdering his wife, he has yet to scratch together the $200,000 he needs to get out of custody. On Monday, a prosecutor argued that Kustok should have no hope at all of securing his release before trial. Cook County Assistant State's Attorney Jennifer Gonzalez moved to have Kustok held without bond. Gonzalez argued that an expert determined Kustok used a gun to kill his wife, Anita Kustok. Since Allan Kustok used a firearm, another 25 years—or even a life term—can be tacked on his sentence if he is found guilty, Gonzalez said during a Monday morning hearing at the Bridgeview courthouse. Murder Case Paperwork Makes it to Court, Alleged Murderer Doesn't

A hearing in the Allan Kustok murder case was postponed when no one brought Allan Kustok to court.

A hearing in the murder case of an Orland Park man charged with gunning down his wife never happened after no one brought the alleged killer to court. "Although his papers have been sent, the body was not," said Rick Beuke, the attorney for Allan Kustok. Kustok was to appear at the Bridgeview courthouse Monday morning, but no one picked him up from where he is being held at the Kankakee County jail. Kustok was taken from the Cook County Jail to Kankakee shortly after his arrest when officials learned he had worked as a sanitarian at the jail from 2004 to 2007 and is familiar with the inner workings of the facility. Defense Wants New Warrant to Search Kustok’s Cell Phone

Attorneys for Allan Kustok, who is accused of shooting and killing his wife, want prosecutors to further justify the need for searching his cell phone, after prosecutors said new technology would allow greater access to evidence on the phone.

  Whether additional evidence gathered from Allan Kustok’s cell phone is allowed in court for the murder case against him will not be decided until March at the earliest. In November, Assistant State’s Attorney Jennifer Gonzalez said during a hearing that technology not available in 2010, when Kustok was accused of murdering his wife Anita “Jeanie” Kustok, would allow a deeper look into data on Allan Kustok’s cell phone, including email archives and Internet use. Judge John J. Hynes asked attorneys for Kustok and prosecutors in December to make arguments as to why new evidence from Kustok’s phone should or shouldn’t be admitted, using any case law they felt would be relevant. Defense Opposes Evidence From Cell Phone in Kustok Murder Case

A Cook County judge will look at case law presented by both sides in the murder case against Allan Kustok before deciding whether to allow new cell phone evidence to be admitted.

Authorities have gained additional evidence from a cell phone recently analyzed with technology that wasn't available two years ago, when Allan Kustok, 61, was arrested and charged in the shooting death of his wife, prosecutors said during a hearing Wednesday. Assistant State's Attorney Jennifer Gonzalez said she filed a motion earlier this month to admit evidence found on the cell phone, though she didn't say what the evidence entails.  Kustok's attorneys, Rich Beuke and co-counsel Ernie DiBenedetto and Randy Rueckert, are opposed to allowing the new evidence, Rueckert said Wednesday as Kustok stood silently beside him. Cell Phone May Reveal New Evidence in Kustok Murder Case

Prosecutors said Wednesday, Nov. 21 that new technology will allow investigators to gather data off of an old cell phone in the murder case against Allan Kustok, 61, who is accused in the 2010 fatal shooting death of his wife.

  A cell phone that has been in the custody of police for more than two years may yield new evidence in the first-degree murder case of Allan Kustok, who is accused of shooting his wife to death in 2010. During a status hearing Wednesday in Judge John J. Hynes' Bridgeview courtroom, Assistant State's Attorney Jennifer Gonzalez said technology that wasn't available in 2010 will allow investigators to take a look at information on the cell phone, including old emails, records of Internet usage and data saved to the SIM card. Hearing for Kustok Murder Case Delayed As Lawyer Deals With Emergency

The attorney for Allan Kustok, who has been charged with murder in the 2010 shooting death of his wife Anita "Jeanie" Kustok, was absent from court Friday, Sept. 28 due to a family emergency, prosecutors said.

Almost exactly two years after the shooting death of his wife, Allan Kustok stood at the podium for defendants in a Bridgeview courtroom Friday, Sept. 28, clad in bright orange inmate scrubs and flocked only by deputies silently guarding him. His attorney, Rick Beuke, was absent from court due to a family emergency, prosecutor Jennifer Gonzalez told Cook County Judge John J. Hynes. The case has been continued until 9:30 a.m. Friday, Oct. 5 in Hynes' courtroom, room 110 at the Bridgeview courthouse.
