Defense: Throw Out Arrest of Drifter Accused in Sex Assault

A public defender for Dennis Dodson, the drifter accused of sexually assaulting a then-83-year-old woman in Orland Park, is filing a motion to quash the arrest based on the identification of Dodson in a photo array.

A public defender for a homeless man accused of sexually assaulting an elderly woman is questioning the photo identification of her client and announced Thursday that she is filing a motion to get his arrest thrown out. Dennis Dodson, 36, is currently in Cook County jail and appeared in Judge John J. Hynes' Bridgeview courtroom in his customary khaki Department of Corrections uniform and ponytail. Prosecutors say on Sept. 26, 2011, Dodson wrestled an elderly woman to the ground, and sexually assaulted her behind the Home Depot at 159th Street and Harlem Avenue, where he was living at the time. Drifter Accused in Sex Assault Wants New Attorney

Accused of sexually molesting an 83-year-old woman in 2011, Dennis Dodson told a Cook County judge Wednesday that he wants a new attorney but the judge refused.

A homeless man charged in the 2011 sexual assault of an 83-year-old woman asked for a new public defender Wednesday, just as it looked as though a trial date may be getting close. But the request was denied by Judge John J. Hynes. Dodson, 36, appeared in Hynes' Bridgeview courtroom with his public defender, whose name could not immediately be confirmed. He has been in custody since Sept. 26, 2011 after receiving no bail during his bond hearing more than a year ago. Prosecutors allege that Dodson wrestled an elderly woman to the ground, and sexually assaulted her behind the Home Depot at 159th Street and Harlem Avenue, where he was living at the time. Drifter Accused of Sexually Assaulting Elderly Woman May Be Nearing Trial

A public defender for Dennis Dodson, the homeless man accused of sexually molesting an 83-year-old woman in 2011, said the evidence phase of the case is complete.

Dennis Dodson, the drifter accused in the 2011 sexual assault of an 83-year-old woman, may be nearing a trial date. A public defender for Dodson said the pre-trial discovery phase of the case is complete, at a hearing in Judge John J. Hynes' Bridgeview courtroom on Wednesday.  Dodson, 35, appeared cleanly shaven in a yellow Department of Corrections jumpsuit with his red hair back in a ponytail. He didn't speak during the brief hearing. He has pleaded not guilty to the September 2011 assault and has been in custody since then on a $1.5 million bond. THURSDAY, MAY 3 Police were called about a retail theft at Macy’s around 9:10 a.m. Security said a woman was recognized in the store from a retail theft a week prior and was carrying the same grey and pink Nike bag, though she wasn’t caught the last time, according to the report. Security saw her enter a dressing room with items, and found after she purchased two items that she had placed nine other items into her purse that she didn’t pay for, police said. Judge Sides with State on DNA Dispute in Rape, Kidnapping Case

Public defenders had been looking to split evidence and conduct separate analysis.

Attorneys for Dennis Dodson argued unsuccessfully on Thursday that the state’s plan to test, and thereby destroy, DNA evidence at the center of the case violates the defendant’s Constitutional right. Dodson, 35, was charged with aggravated criminal sexual assault and aggravated kidnapping for allegedly molesting an 83-year-old woman behind the Orland Park Home Depot in 2011. Special prosecutor Clarissa Palermo said she’s looking to test all four swabs taken from the victim, on the recommendation of a state forensic scientist who has argued that he needs to test each sample to know with certainty whether a complete DNA profile of Dodson is present. A drifter accused of violently molesting an 83-year-old Good Samaritan and threatening a man behind the Orland Park Home Depot this summer pleaded not guilty on Thursday. Dennis Dodson, 35, has been charged with aggravated criminal sexual assault, a Class X felony, and assault. Prosecutors allege that, in September, Dodson wrestled an elderly woman to the ground—forcefully inserting his finger—behind the Home Depot, at 159th Street and Harlem Avenue, where he was living at the time.
