Orland Plaza Tenants Have Until Aug. 30 to File Objections to Settlement

Judge will hear objections, if they are filed, at a hearing in October.

While Orland Park and the Orland Plaza landowners have agreed on a settlement, actions in court are far from over. Plaza tenants’ attorneys have until Aug. 30 to file objections to the final judgment order in nearly three years of eminent domain litigation between Orland Park and plaza owners George Gee and Joseph Mikan. As of Friday, no objections had been filed, though tenant attorneys Mike and Bill Ryan said in July that language in the settlement between Gee, Mikan and the village leaves too much uncertainty for tenants to start planning to move out of the plaza. The owners of a 25-year Orland Park business take stock as Orland Plaza development plans inch forward.

Five years ago they were advised not to make any improvements to their grocery store. No long-term planning. No investments. Change light bulbs and toilet paper only. Something was going on, and the owners of Randy’s Market knew it. To hear them tell it, trouble wasn’t so much brewing as it was boiling over at village hall. Why else would a former landlord have made the odd suggestion? As it turns out, the village was preparing to make an offer for the purchase of Orland Plaza—bound loosely between LaGrange Road, 143rd Street and Southwest Highway—of which Randy’s is the anchor. Main Street Triangle Case Delayed Again Without Judge

Possibility of an out-of-court settlement is growing, though attorneys for the Orland Plaza tenants say they aren't part of those discussions.

Main Street Triangle court proceedings were stalled again this week as attorneys waited for the appointment of a new judge. Judge Sanjay Tailor was reassigned in January to the commercial division of the Cook County Circuit Court, interrupting efforts to set a fair price for the Orland Plaza property, which the village was awarded through eminent domain. Orland Park officials plan to turn the area bound by LaGrange Road, 143rd Street and Southwest Highway into a pedestrian-friendly city center with shops, offices, restaurants and condominiums. Attorneys for both sides met in court Thursday and received a new status date for June 16 with the expectation that a judge will be assigned by then. That's if a settlement hasn't been reached. Orland Triangle: Plaza Tenants Want Their Day in Court Now

Orland Plaza businesses owners want to argue in court how much they should be paid to leave their stores during the same proceedings that will decide how much the village must pay the property owner.

Orland Plaza tenants are fighting for a place at the negotiating table when a jury decides how much Orland Park will pay the shopping center's property owner for the land the village covets for the Main Street Triangle project. Attorneys for the business owners who lease space in Orland Plaza are scheduled to argue in court Thursday afternoon that they should present their desired damages for moving out of the plaza during the eminent domain case between the village and landowner. "The business owners have the most at stake here, and being forced to move during one of the most unprecedented downturns in the economy is a risky thing," said Stephen Viz, an attorney representing eight of the 27 businesses now in the Plaza. I totally agree to leave the shopping plaza as is. Many residents who have lived here for years, including my family, disagree with all the unnecessary changes at that location. Aren't there enough vacant buildings in Orland Park now? Do something about those other buildings.
