Key Witness' Firing Could Be 'Turning Point' for Sex Assault Case, Defense Says

The defense attorney for Robert Phelan, an Oak Lawn man accused of sexually assaulting a 93-year-old dementia patient at an Orland Park care facility, said Monday, Jan. 28 that the state's key witness is involved in a civil lawsuit with the facility.

A supervising nurse and key witness against an Oak Lawn man accused of sexually assaulting a then-93-year-old dementia patient at an Orland Park care facility has been fired from the facility and is now involved in a civil lawsuit, a defense attorney said Monday, Jan. 28. Robert Phelan, 58, is out on $350,000 bond in connection to the July 24, 2011 alleged incident, where authorities say he sexually assaulted the elderly woman at the facility where he was working as a nurse's assistant. Attorney Wants Arrest Thrown Out in Sex Abuse Case

The attorney for Robert Phelan, accused of sexually assaulting a 93-year-old dementia patient at an Orland Park care facility, has filed a motion to quash Phelan's arrest in the case.

The defense attorney representing an Oak Lawn man accused of sexually assaulting a 93-year-old dementia patient said Tuesday that he will argue motions to suppress the man's arrest. Howard J. Wise, attorney for Robert Phelan, told Judge Colleen Ann Hyland during a status hearing in her Bridgeview courtroom that he filed the motion about three weeks ago. Wise didn't give any details about the motion; Patch was unable to get comment after Tuesday's hearing. Phelan, 57, is accused of sexually assaulting the 93-year-old dementia patient while she was being treated at an Orland Park care facility on July 24, 2011, where he was working as a nurse, according to prosecutors. State Doesn't Want Alleged Elderly Sex Abuse Victim to Face Accuser

A prosecutor asked that a statement uttered immediately after the alleged sexual assault by Robert Phelan, 57, be admitted as an exception the hearsay rule. Phelan's attorney Howard Wise says the statement in question doesn't qualify.

A Cook County judge will rule next month on whether a statement reportedly made by an elderly sex abuse victim will be allowed in court or barred because it's hearsay. Robert Phelan, 57, of Oak Lawn is accused of sexually assaulting the 93-year-old dementia patient while she was treated at an Orland Park care facility, where he was working as a nurse, according to prosecutors.
